Circumstances Excluding Wrongfulness as a State's Defence against Foreign Investors due to Pandemic

Annotation: | The project, based in the area of international investment law within the frame of general international public law is confined to the possibility of application of circumstances, excluding wrongfulness of the state’ conduct by the host state against foreign investors, who file claims against the host state due to the expropriation and nationalization of their international investments, localized on the host state’s territory in times of pandemic. The main goal of the project is a determination of the most advantageous use of circumstances precluding wrongfulness in favour of the host state under Articles on State Responsibility of the UN ILC. The subject of the research is expropriation of foreign investments within the host state’s territory for the public purpose due to pandemic. As the foreign investor usually initiates international investment arbitration against an expropriating state as a follow up, it is important to recognize all the possibilities of the state to defend itself against such claims. |

Annotation: | The issue of intelligent mobility is linked to a wide range of issues from constitutional and philosophical areas (answer to the question of who to sacrifice in the event of an accident), GDPR issues, social aspects (autonomous vehicle for older drivers as a tool for the inclusion of an aging population ...) to questions labor shortages in specific areas (public transport drivers, couriers ....). With the growing pressure towards the modernization of society (modernization of transport), the pressure on law - making reflecting social development is growing. The aim of the project is to summarize foreign experience and legislation governing smart mobility in order to create the conditions for the design of a model of smart mobility in the Slovak Republic. |

Annotation: | The present project aims to explore the unique links between sport, law and the economy. The result should be a proposal for a more conceptual solution to the regulation of the sports market in the conditions of (Slovak) sport, based on evidence-based research in this area, in comparison with EU law and the law of neighbouring Central European countries. The basic complaint addressed to the authors of the Act on sports is an excessive idealism of their ideas, copying legislation in the rest of Europe, whereby the counter-argument by market players is the specificity of the Slovak sports market, which would in reality never be able to cope with the standards introduced in the other countries. The above-mentioned schism between the reality of the sports market and the legal ideals of its regulation is a key issue of the efficiency and effectiveness of sports legislation in the Slovak Republic, which must clearly be objectively assessed before starting to gradually abandon the originally introduced standards. |
The Influence of the Copernican Turns in Philosophy on Changes in Legal Paradigms

Annotation: | The project maps the impact of selected paradigmatic changes in philosophy on the changes of legal paradigms. Subsequently, it focuses more deeply on the impact of the so-called linguistic turn from the analytical philosophy of the twentieth century (especially in the version of the late Ludwig Wittgenstein) on the legal philosophy. It also aspires to identify the ways in which linguistic turn can be used fruitfully, for example by realizing which questions of legal theory can be posed meaningfully as there is a meaningful answer possible. Moreover, it aspires to bring some light to discussions on interpretation in law. At the same time, the project builds hypotheses for the future development of legal science. It also focuses on the use of the new findings of philosophical ethics and partially applied ethics and their possible practical use in professional ethics. The project thus bridges two "separate" disciplines and it strives to perceive the law as the social practice. |
